Terms and Conditions
InkManager
1. Scope
These Terms and Conditions apply to the use of the InkManager platform (hereinafter "Platform") by tattoo studios and customers. Deviating terms only apply if confirmed in writing.
2. Service Description
InkManager provides a platform through which studios can offer appointments and customers can view motifs, book, and manage appointments. The platform does not provide medical services; the execution of tattoos is carried out exclusively by the respective studio.
3. Contract Formation
Contracts for services between the studio and the customer are concluded directly between these parties. InkManager merely provides the technical platform. InkManager is not a contractual partner for the tattooing service.
4. Prices and Payment
Prices for services are set by the respective studio. Payments are made according to the payment options offered by the studio. InkManager may charge fees for certain services; these are displayed transparently before use.
5. Cancellation and Rebooking
Cancellation conditions are governed by the agreements of the respective studio. InkManager recommends that studios publish clear cancellation policies in their profiles.
6. User Obligations
Users agree not to upload any unlawful, offensive, or copyright-infringing content. Studios must provide accurate information regarding prices, duration, and availability.
7. Liability and Exclusion of Liability for Misuse
InkManager liability: InkManager is liable for intent and gross negligence. For slight negligence, InkManager is only liable in the event of breach of material contractual obligations; liability in this case is limited to the typically foreseeable damage.
Liability for misuse: InkManager is not liable for damage caused by misuse of the platform (e.g. false information, manipulation, unauthorised access by third parties). Users who misuse the platform are liable for resulting damage and may be blocked.
Studio liability: Studios are liable for the proper execution of the tattoo and for the accuracy of their information.
8. User Content and Copyright
Users grant InkManager a simple, non-exclusive right to use uploaded motifs and images for display on the platform. Studios warrant that they hold the necessary rights to uploaded motifs. In the event of copyright infringement, statutory takedown procedures apply.
9. Suspension and Termination
InkManager may suspend or terminate users in the event of violations of these Terms. Terminations are communicated in writing.
10. Final Provisions
German law applies. The place of jurisdiction is, to the extent permissible, the registered office of the operator. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
